Then through that process, as a result of coming before the courts, it then became clear as to what may be impacting his behaviour, thus the next steps were taken for an assessment to be done, which is the way the process should work."Immediate help can be offered to people when they are arrested by police under the Mental Health Act, "but that wasn't the case here," Thiessen said."If we had initiated an arrest under the Mental Health Act, then different mechanisms would come into play," he added.Crown spokesman Neil MacKenzie said prosecutors did not request that Douglas Nikkel be kept in custody for the three weeks, but said he could not discuss any details about the case or the steps taken by the Crown because this is "an ongoing case before the court."However, he did say that it was his understanding that Nikkel was kept in custody because his bail documents weren't properly completed. He noted that Nikkel was granted bail Dec. 19, and that Crown had not sought an order to keep him in custody.MacKenzie added: "It's a difficult situation because we have to balance privacy obligations with providing an explanation as to what's taken place up to this point."Russell Nikkel has been in contact with the psychiatric hospital and hopes to visit his brother after he stabilizes.
